Terms of Service

These Terms of Service (“Terms”) govern your use of the everriseneural.com website (the “Site”), operated by EverRise Neural Inc. (“EverRise Neural,” “we,” “us”), 16192 Coastal Highway, Lewes, Delaware (registered agent address). By using the Site you agree to these Terms. If you do not agree, do not use the Site.

1. Scope

The Site provides information about EverRise Neural and a way to contact us. Our platform, API and private deployments are provided only under subscription terms or a separate written agreement, including the terms presented in the relevant product, such as the web chat at ui.everriseneural.com. If those terms conflict with these Terms, the separate terms control for that product.

2. Eligibility and business use

The Site is intended for business users in the United States. You must be at least 18 years old and able to form a binding contract.

3. Acceptable use

You agree not to: violate any law or regulation; attempt to gain unauthorized access to the Site or related systems; interfere with its operation or security; scrape or overload it with automated requests; introduce malware; or submit through the contact form any classified information, controlled unclassified information, protected health information, credentials, secrets or confidential third-party information.

4. Inquiries are not contracts

Sending a message does not create a customer relationship, a license, or any obligation for either party. Statements on the Site about our products, research and capabilities are general information, not offers, warranties or commitments, and may change without notice.

5. Intellectual property

The Site and its content, including the EverRise names, logos and designs, are owned by EverRise Neural Inc., EverRise Global LLC or their licensors, and are protected by U.S. and international intellectual property laws. Model architectures, weights and related technology are proprietary. We grant you a limited, revocable, non-exclusive license to view the Site for your internal business evaluation. Nothing else is licensed.

6. Feedback and ideas

If you send us ideas, suggestions or research proposals, you agree we may use them without obligation to you, unless we have signed a written agreement that says otherwise. Do not send confidential or proprietary information unless we have agreed to receive it in writing.

7. Third-party services and links

The Site may link to or rely on third-party services, such as our form processor and font provider. We do not control them and are not responsible for their content or practices.

8. Export controls

Our technology may be subject to U.S. export control and sanctions laws, including the Export Administration Regulations and regulations administered by the Office of Foreign Assets Control. You agree to comply with these laws and not to access or use our technology in violation of them.

9. Disclaimer

The Site is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy or availability, to the fullest extent permitted by law.

10. Limitation of liability

To the fullest extent permitted by law, EverRise Neural Inc. and its affiliates, officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the Site. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless EverRise Neural Inc. from claims, losses and expenses, including reasonable attorneys’ fees, arising from your breach of these Terms or your misuse of the Site.

12. Governing law and venue

These Terms are governed by the laws of the State of Delaware and applicable U.S. federal law, without regard to conflict-of-law rules. You and EverRise Neural Inc. agree that any dispute will be brought exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction.

13. Changes and termination

We may update these Terms or restrict access to the Site at any time. Changes take effect when posted, and the “Last updated” date will change. Continued use means you accept the updated Terms.

This Privacy Policy explains how EverRise Neural Inc. (“EverRise Neural,” “we,” “us”) handles personal information collected through everriseneural.com (the “Site”). Our registered agent address is 16192 Coastal Highway, Lewes, Delaware. It does not cover the web chat at app.everriseneural.com or customer deployments, which are governed by their own terms and agreements.

1. Information we collect

When you use our contact form we collect the information you provide: name, organization, work email, optional phone number, organization type, area of interest and your message. Like most websites, our hosting and delivery providers may automatically process technical data such as IP address, browser type and request logs for security and operations.

2. How we use it

We use your information to respond to inquiries, evaluate and follow up on potential business or research collaboration, operate and secure the Site, comply with legal obligations, and protect our rights. We do not use contact form submissions to train our models.

3. Who we share it with

We share information only with service providers that help us run the Site and handle inquiries, and only as needed. These include Formspree, which processes contact form submissions on our behalf, our hosting provider, and Google Fonts, which receives your IP address when your browser loads the Site’s typefaces. We may also disclose information when required by law or to protect rights, safety and security, or in connection with a merger, acquisition or sale of assets. We do not sell personal information and we do not share it for cross-context behavioral advertising.

4. Cookies and tracking

We do not set advertising or analytics cookies on the Site. Third-party providers described above may process limited technical data as part of delivering their services.

5. Do not send sensitive information

Please do not submit classified information, controlled unclassified information, protected health information, government identifiers, financial account numbers, credentials, secrets or confidential third-party information through the Site or by email to the addresses listed here.

6. Retention

We keep inquiry information for as long as needed to respond and maintain our business records, and then delete or anonymize it unless the law requires us to keep it longer.

7. Security

We use reasonable administrative and technical measures to protect information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

8. Your U.S. privacy rights

Depending on where you live, including California and other U.S. states with comprehensive privacy laws, you may have the right to know what personal information we hold about you, to access, correct or delete it, to obtain a copy, and to not be discriminated against for exercising these rights. To make a request, email contact@everriseneural.com. We may need to verify your identity, and you may use an authorized agent where the law allows. We do not sell or share personal information as those terms are defined by these laws.

9. Children

The Site is intended for business users and is not directed to anyone under 18. We do not knowingly collect personal information from children. If you believe a child has sent us information, contact us and we will delete it.

10. Changes

We may update this Policy from time to time. The “Last updated” date shows the latest version.
